An Exclusive Right

 

Patent is an exclusive right granted to the inventor (patentee) to gain commercial advantage over his invention.

 

For an invention to be patentable, the invention must be a new product or process involving an inventive step and capable of industrial application. Inventive step is also an invention.

  • Subject matter of Patent:

    For an invention to be patentable, the invention must be

    • New,
    • Useful and
    • Non-Obvious.
    • The invention should not have been disclosed in public (published or sold)
  • Term of Patent:

    Patent grant is given for a period of 20 years from the date of filing the patent application.

    In case of international application filed under PCT shall be twenty years from the date of filing international filing accorded under PCT.
